1. Services
The scope, deliverables, timelines and fees for each engagement are defined in the proposal or agreement signed between you and DigiCap Media.
2. Payments
- Monthly retainers are payable in advance. One-time projects typically require an advance payment before work begins.
- Advertising spend is paid directly to the ad platforms and is separate from our fees.
- Prices are exclusive of applicable taxes (GST).
3. Client responsibilities
You agree to provide timely access, approvals, content and information required to deliver the services.
4. Results
Digital marketing outcomes depend on many factors outside our control, including search engine and platform algorithms, competition and market conditions. We do not guarantee specific rankings, traffic or revenue.
5. Intellectual property
Upon full payment, final deliverables created specifically for you are transferred to you. We may showcase non-confidential work in our portfolio unless agreed otherwise.
6. Confidentiality
Both parties agree to keep confidential information private and use it only for the purpose of the engagement.
7. Termination
Either party may terminate a retainer with 30 days' written notice after the initial minimum term. Fees for work completed remain payable.
8. Limitation of liability
To the extent permitted by law, DigiCap Media's liability is limited to the fees paid for the specific service in the preceding month.
9. Governing law
These terms are governed by the laws of India, and disputes are subject to the jurisdiction of the competent courts in India.
